These Terms of Use govern your use of the AIMS Advisor for Microsoft Sovereign AI Copilot extension (the “Service”). By installing or using the Service, you agree to these Terms.

These Terms are in addition to, and do not supersede, the Microsoft Commercial Marketplace Standard Contract under which AppSource transactions are governed unless an explicit Negotiable Section overrides a clause below.

2. Advisory nature; no certification

The Service is advisory only. It validates the artifacts you submit against the cited AIMS specification sections and returns conformance findings. It does NOT issue any form of certification, accreditation, attestation, or other formal status; constitute legal, regulatory, compliance, or audit advice; replace your obligation to perform independent verification; or guarantee that artifacts that pass validation will perform any specific real-world function or satisfy any third-party requirement.

Extended Systems, Inc. and its XSI subsidiary do not operate a formal AIMS conformance program. Use of the Service does not entitle you to claim “AIMS-certified,” “AIMS-conformant by XSI authority,” or any equivalent — only “validates against AIMS §X.Y” framing is appropriate.

3. License

Extended Systems, Inc. grants you a non-exclusive, non-transferable, revocable license to use the Service for your internal business purposes during your active subscription term.

The AIMS specification itself is published by Extended Systems Intelligence Corporation (the XSI subsidiary) as an open standard at github.com/Extended-Systems-Intelligence/aims-standard under its own license terms.

4. Acceptable use

You agree NOT to: violate applicable law; reverse-engineer the validator backend; probe security except via coordinated disclosure to security@xtendedsystems.com; submit infringing or unlawful content; resell or rebrand without an explicit reseller agreement; claim certification (per §2); or exceed documented rate limits.

6. Spec re-pin policy

The validator backend is pinned to a specific AIMS spec version. Extended Systems, Inc. may re-pin to a newer version with at least 30 days' advance notice via the AppSource publisher communication channel and this support page. Re-pin is wire-format-compatible by design.

7. Service level (no SLA in V1)

V1 ships without a formal SLA during the AppSource preview window. Extended Systems, Inc. targets > 99 % monthly availability and < 1 second p99 latency but does not contractually guarantee these in V1. A formal SLA accompanies the V2 (GA) release.

The Service is provided “AS IS” and “AS AVAILABLE.” To the fullest extent permitted by law, Extended Systems, Inc. disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

10. Limitation of liability

To the fullest extent permitted by law, Extended Systems, Inc.'s aggregate liability arising out of or relating to these Terms or the Service is limited to the amount you paid through the AppSource commerce channel for the 12 months preceding the event giving rise to the claim. Extended Systems, Inc. is not liable for indirect, incidental, consequential, special, exemplary, or punitive damages.

11. Termination

You may stop using the Service and uninstall the agent at any time via the M365 Copilot agent picker. Extended Systems, Inc. may terminate or suspend the Service for material breach. Sections 2, 8, 9, 10, and this §11 survive termination.

12. Governing law

These Terms are governed by the laws of the State of Idaho, USA, excluding its choice-of-law rules. Disputes are subject to the exclusive jurisdiction of the state and federal courts located in Ada County, Idaho.

13. Changes to these Terms

Extended Systems, Inc. may update these Terms with 30 days' notice via the AppSource publisher communication channel.
